Welcome to Matcha Program ("Matcha Program," "we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the Matcha Program website, digital resources, educational content, downloadable materials, products, services, and any related offerings (collectively, the "Services"). By accessing or using Matcha Program, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

Educational Purpose

Matcha Program provides educational resources intended to help café owners, operators, managers, baristas, and hospitality professionals improve their matcha programs. All content is provided for educational and informational purposes only and should not be considered legal, financial, accounting, tax, regulatory, food safety, or professional business advice. Every café operates differently. You are responsible for determining whether any recommendation is appropriate for your business and for complying with all applicable laws, regulations, manufacturer guidance, and food safety requirements.

Intellectual Property

All content published by Matcha Program—including but not limited to PDFs, audits, SOPs, templates, worksheets, calculators, educational guides, videos, graphics, illustrations, branding, logos, trademarks, text, course materials, and other original works—is owned by or licensed to Matcha Program and is protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of any intellectual property to you. The unauthorized use of Matcha Program content for artificial intelligence training, machine learning, automated data extraction, dataset creation, or similar technologies is expressly prohibited. No license or permission for such use is granted unless expressly authorized in writing by Matcha Program.

License to Use Our Resources

Unless otherwise stated, Matcha Program grants you a limited, non-exclusive, non-transferable, revocable license to use our resources for your own personal or internal business purposes.

You may:

  • Download resources you have lawfully obtained.

  • Print copies for your own internal business use.

  • Use the materials within your own café or organization.

  • Train employees within your organization using licensed Matcha Program resources.

You may not:

  • Share downloaded resources with individuals or organizations outside your business.

  • Upload resources to public websites, cloud storage services, file-sharing platforms, social media platforms, AI platforms, or public repositories.

  • Reproduce, copy, distribute, modify, translate, adapt, or create derivative works from our materials.

  • Sell, sublicense, rent, lease, or commercially exploit our resources.

  • Use our materials to create competing educational products, consulting services, training programs, or digital resources.

  • Remove or obscure any copyright notices, trademarks, branding, watermarks, or other proprietary notices contained within Matcha Program materials.

  • Represent Matcha Program content as your own.

  • Enterprise, franchise, or multi-location use may require a separate licensing agreement.

Artificial Intelligence & Automated Systems

Unless expressly authorized in writing by Matcha Program, you may not use, reproduce, scrape, copy, download, extract, index, or otherwise utilize any portion of our content, materials, or resources—including but not limited to text, graphics, logos, PDFs, audits, SOPs, templates, worksheets, calculators, videos, educational materials, or other intellectual property—for the purpose of: Training, fine-tuning, evaluating, or improving artificial intelligence, machine learning, large language models, or other automated systems. Creating datasets, embeddings, vector databases, knowledge bases, or other machine-readable repositories. Developing, operating, or enhancing AI-powered products, automated content generation systems, retrieval systems, recommendation engines, search systems, or similar technologies. Building products or services that compete with Matcha Program. Any commercial or automated use not expressly authorized in writing by Matcha Program. No license or permission is granted for any artificial intelligence, machine learning, automated data extraction, or similar use of Matcha Program content unless explicitly authorized in writing.

Team Use

If you operate a café or hospitality business, your employees may use licensed Matcha Program resources solely for internal training within your organization. Distribution outside your organization requires prior written permission from Matcha Program. Enterprise, franchise, or multi-location licensing may require a separate agreement.

User Feedback

If you voluntarily provide suggestions, ideas, recommendations, comments, or other feedback regarding Matcha Program, you grant us permission to use that feedback to improve our products, services, educational resources, and customer experience without obligation or compensation.

User Submissions

If you submit audit results, survey responses, testimonials, photographs, videos, or other content to Matcha Program, you represent that:

  • You own the content or have permission to submit it.

  • The information is accurate to the best of your knowledge.

  • Sharing the content does not violate the rights of any third party.

  • Unless you request otherwise, you grant Matcha Program a non-exclusive, worldwide, royalty-free license to use submitted content for educational, research, marketing, and promotional purposes. If we intend to identify your café, company, or organization by name in marketing materials, we will seek your permission first.

Accuracy of Information

We strive to provide accurate, practical, and current educational information. However, Matcha Program makes no guarantee that all information is complete, accurate, or suitable for every business. Industry practices, products, and recommendations may evolve over time, and content may be updated without notice.

No Guarantees

Every café is different. Matcha Program does not guarantee that using our resources will increase revenue, improve profitability, reduce costs, improve customer satisfaction, improve operational efficiency, or produce any specific business outcome. Your results depend on numerous factors outside our control.

Third-Party Links

Our website or educational materials may contain links to third-party websites, products, or services. These links are provided for convenience only. Matcha Program is not responsible for the content, policies, availability, or practices of any third-party website or service.

Limitation of Liability

To the fullest extent permitted by applicable law, Matcha Program shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of the Services. To the maximum extent permitted by law, Matcha Program's total liability for any claim relating to the Services shall not exceed the amount you paid, if any, for the specific product or service giving rise to the claim.

You agree to indemnify, defend, and hold harmless Matcha Program from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of: Your use or misuse of the Services. Your violation of these Terms. Your violation of any applicable law or regulation. Your infringement of another person's rights.

Privacy

Your use of Matcha Program is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

Digital Products

Matcha Program may offer digital products, including but not limited to downloadable audits, guides, templates, worksheets, calculators, SOPs, training materials, courses, and other educational resources. Unless otherwise stated in writing:

  • All digital products are licensed, not sold.

  • Your purchase or download grants you a limited license to use the product in accordance with these Terms and does not transfer ownership of any intellectual property.

  • Digital products may not be copied, redistributed, resold, sublicensed, shared outside your organization, or used for any purpose prohibited by these Terms.

Because digital products are delivered electronically and are generally accessible immediately upon purchase or download, all sales are final. Matcha Program does not offer refunds, exchanges, or cancellations for digital products except where required by applicable law. If you experience technical difficulties accessing or downloading a purchased resource, please contact us. We will make reasonable efforts to resolve the issue or provide an alternative means of access. From time to time, Matcha Program may update or revise digital products to improve accuracy, quality, or functionality. Unless otherwise stated, the purchase of a digital product does not guarantee access to future updates, revisions, or new editions.

Unless otherwise indicated, all original content created and published by Matcha Program—including but not limited to audits, guides, SOPs, templates, worksheets, calculators, educational materials, graphics, videos, text, and other original works—is protected by applicable copyright laws.

Any unauthorized reproduction, distribution, public display, modification, or commercial use of Matcha Program's copyrighted materials outside the license granted in these Terms is prohibited.

Reservation of Rights
